Welcome to LearnTender (“LearnTender,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your access to and use of www.learntender.com, our online learning platform, courses, certifications, websites, applications, and related services (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

8. Brand-Sponsored Training

Some courses are sponsored by cannabis brands, manufacturers, distributors, retailers, or employers.

When you participate in sponsored training, you acknowledge that LearnTender may provide the sponsoring organization with information including:

  • Your name
  • Email address
  • Employer
  • Enrollment status
  • Course progress
  • Quiz scores
  • Completion dates
  • Certificates
  • Badge achievements

Such reporting is part of the Services.

9. Employer Training

If your employer or dispensary assigns training through LearnTender, your employer may receive reports regarding your participation and performance, including course completion, quiz scores, certifications, and related training records.

10. Payments

LearnTender may offer:

  • Free courses
  • Paid courses
  • Subscriptions
  • Enterprise licenses
  • Brand-sponsored training

Prices may change at any time.

Applicable taxes may be added where required by law.

Payment processing may be handled by third-party providers.

11. Refunds

Refund eligibility, if offered, will be described at the time of purchase.

Unless otherwise required by law, digital educational content may become non-refundable once access has been granted.

12. Acceptable Use

You retain ownership of your content.

By submitting content, you grant LearnTender a non-exclusive, worldwide, royalty-free license to host, reproduce, display, process, and distribute such content solely as necessary to provide and improve the Services.

You represent that you have all necessary rights to upload your content.

14. Intellectual Property

All LearnTender content, including:

  • Courses
  • Videos
  • Graphics
  • Logos
  • Text
  • Software
  • Quizzes
  • Certifications
  • Website design
  • Platform functionality

is owned by LearnTender or its licensors and is protected by intellectual property laws.

Nothing in these Terms transfers ownership of LearnTender intellectual property to you.

15. Brand Content

Cannabis brands retain ownership of the trademarks, logos, educational materials, packaging, images, and product information they provide to LearnTender.

Brands grant LearnTender the rights necessary to host and display their content within the Services.

16. Limited License

Subject to these Terms, LearnTender grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business learning purposes.

You may not:

  • Copy courses
  • Redistribute videos
  • Download protected materials without authorization
  • Sell course materials
  • Reproduce quizzes
  • Share certification exams
  • Create competing educational products using LearnTender content

17. Copyright Complaints

LearnTender respects intellectual property rights.

If you believe copyrighted material has been used without authorization, please contact:

We may remove allegedly infringing content while investigating claims.

18. Privacy

Your use of LearnTender is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.

We are not responsible for third-party services or their policies.

22. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEARNTENDER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

23. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEARNTENDER, ITS OWNER, AFFILIATES, CONTRACTORS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF BUSINESS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

IN NO EVENT SHALL LEARNTENDER’S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LEARNTENDER DURING THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100), TO THE EXTENT PERMITTED BY LAW.

24. Indemnification

You agree to defend, indemnify, and hold harmless LearnTender, its owner, contractors, affiliates, licensors, and service providers from claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your content, or your violation of these Terms or applicable law.

25. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles, except where applicable law requires otherwise.

26. Changes to These Terms

We may modify these Terms from time to time.

Updated Terms become effective upon posting to the Services unless otherwise stated.

Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

27. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

28. Entire Agreement

These Terms, together with our Privacy Policy and any additional policies incorporated by reference, constitute the entire agreement between you and LearnTender regarding your use of the Services.
